WHAT IS HALALA? WHAT QURAN AND HADEES SAYS ABOUT IT?

Nowadays, halala is the talk of the town, especially for the people who are active on social media. It has been observed that most of the people who are engaged in discussion do not know its actual meaning, or they are commenting to distort its meaning to malign Islam and its teachings. Before describing halala, you must understand halala and its procedures according to the Quran and Hadees, the Prophet Mohammad PBUH's sayings (Peace be upon him).

In this regard, the Quran states, “Divorce may be pronounced twice; then the wife may either be kept back in fairness or allowed to separate in fairness." (Al Baqarah 229). Further, the Quran states in Surah Al-Baqarah (2:230) that after a third divorce, a man/woman can only return to the first husband/wife after fulfilling certain conditions.

To understand talaq, we need to go through it in detail. suppose if a man divorces a woman by pronouncing talaq, he cannot be separated just by pronouncing it three times at a time. He has to wait for 3 months and thirteen days after every talaq so that it can be confirmed that the woman who has been pronounced talaq is not pregnant. During pregnancy, it would be null. During its two pronouncements, it is reconciliation, but after the third one and completion of its Iddah, it would be final.

In Islam, "halal" refers to a specific process following a divorce, particularly after a third and final talaq (irrevocable divorce). Once the third talaq is pronounced, the couple cannot remarry unless certain conditions are met.

Some people from intra and inter-faith believe that in the case of halala, a temporary marriage is organised where a divorced woman is said to marry her relative (he may be a brother-in-law) and he will pronounce talaq three times at a time. And now she can return to her first husband, which is completely HARAM in Islam.

There will be no preplanning. Her second marriage shall be organised similarly to the first one later on, if she feels the previous one was better than her the first one. In that case, the similar three-talaq procedure shall be adopted that was adopted during the first one. There would be a three-month and thirteen-day waiting period after every talaq, and then she can return to the previous husband.

The primary objective of halala is to emphasise the seriousness of marriage and divorce, discouraging arbitrary separations. It has been observed that some people have misused this concept through temporary marriages, which are un-Islamic and exploitative, contrary to Islamic values. Halala is intended for genuine situations, not manipulation.
